MESSAGE OF MÉXICO.

Estimado Presidente:

México se congratula por la apertura a firma de este instrumento, que constituye un avance histórico en la gobernanza digital global y un parteaguas en los esfuerzos multilaterales por garantizar un ciberespacio seguro, inclusivo y basado en la cooperación.

Nuestro país reconoce el liderazgo de Viet Nam por acoger esta conferencia y expresa su deseo de que este evento marque el inicio de una nueva etapa de cooperación global en la lucha contra la ciberdelincuencia, bajo los principios de solidaridad, respeto mutuo y responsabilidad compartida.

Este nuevo marco constituye una oportunidad histórica para reforzar la arquitectura penal y procesal frente a los delitos cibernéticos, y para impulsar la armonización legislativa interna en materias como el acceso ilícito, la interferencia con sistemas, la protección de datos personales y la difusión no consentida de imágenes íntimas.

El instrumento habilita mecanismos adicionales de cooperación internacional, permitiendo la transmisión expedita de pruebas electrónicas, la asistencia jurídica mutua y la colaboración técnico-operativa 24/7 entre autoridades.

La Convención se convierte en el primer instrumento universal jurídicamente vinculante en la materia y, al mismo tiempo, en un nuevo pilar del sistema internacional de cooperación penal, complementando a la Convención de las Naciones Unidas contra la Delincuencia Organizada Transnacional (2000) y a la Convención contra la Corrupción (2003).

Veinte años después de la adopción de la UNCAC, este tratado representa el instrumento internacional, en el ámbito penal, de mayor envergadura adoptado en el marco de las Naciones Unidas, fortaleciendo la arquitectura global de justicia y cooperación.

La Convención pone al ser humano en el centro del proceso multilateral, al equilibrar la lucha contra la ciberdelincuencia con la salvaguarda de los derechos humanos, la privacidad, la libertad de expresión y la protección de las mujeres, niñas y grupos vulnerables.

Refleja también un Estado del arte normativo en materia de derechos humanos digitales, situando a la ONU como el foro natural para construir consenso en un entorno tecnológico en rápida evolución.

Por primera vez en un tratado de este tipo, se reconocen significativamente las contribuciones de múltiples partes interesadas, en el diseño de soluciones colectivas a las amenazas digitales. México reconoce el carácter inclusivo del proceso, que reafirmó la legitimidad y viabilidad del instrumento.

México avanza en sus procesos internos de armonización legislativa y valoración jurídica, con miras a culminar su vinculación a este tratado en el corto plazo.

Confiamos en que este nuevo régimen fortalecerá la confianza en el multilateralismo y en la capacidad de las Naciones Unidas para ofrecer respuestas colectivas a los desafíos de la era digital.

Dear President:

Mexico welcomes the opening for signature of this instrument, which represents a historic milestone in global digital governance and a turning point in multilateral efforts to ensure a safe, inclusive, and cooperative cyberspace.

Our country acknowledges the leadership of Viet Nam in hosting this conference and expresses its hope that this event will mark the beginning of a new era of global cooperation in combating cybercrime, guided by the principles of solidarity, mutual respect, and shared responsibility.

This new framework constitutes a historic opportunity to strengthen the criminal and procedural architecture to address cybercrime, and to promote domestic legislative harmonization in areas such as unlawful access, system interference, personal data protection, and the non-consensual distribution of intimate images.

The instrument enables additional mechanisms of international cooperation, allowing for the expedited transmission of electronic evidence, mutual legal assistance, and 24/7 technical and operational collaboration among competent authorities.

The Convention becomes the first universal, legally binding instrument in this field and, at the same time, a new pillar of the international system of criminal cooperation, complementing the United Nations Convention against Transnational Organized Crime (2000) and the Convention against Corruption (2003).

Twenty years after the adoption of the UNCAC, this treaty represents the most comprehensive international instrument in the criminal domain adopted under the auspices of the United Nations, reinforcing the global architecture of justice and cooperation.

The Convention places the human being at the center of the multilateral process by balancing the fight against cybercrime with the safeguarding of human rights, privacy, freedom of expression, and the protection of women, children, and vulnerable groups.

It also reflects a state-of-the-art approach to digital human rights, positioning the United Nations as the natural forum for building consensus in a rapidly evolving technological environment.

For the first time in a treaty of this nature, the significant contributions of multiple stakeholders are recognized in the design of collective solutions to digital threats. Mexico commends the inclusive nature of the process, which reaffirmed the legitimacy and viability of the instrument.

Mexico is advancing its internal processes of legislative harmonization and legal review, with a view to completing its adherence to this treaty in the short term.

We trust that this new regime will strengthen confidence in multilateralism and in the United Nations’ capacity to deliver collective responses to the challenges of the digital age.
